Welcome to the Tuesday Slot, this week we welcome Pete Gibbes, with another Secret Shopper report. Pete as Secret Shopper Coordinator, has revised the secret shopper questions, this is part 1.

But first a quick summary of some news from the Spanish Courts. Canarian Legal Alliance has reported that last week they received eleven (11) new sentences, these were against Anfi Del Mar, Silverpoint and Petchey Leisure. Once again the courts have declared the contracts null and void, plus ordering the return of substantial sums of money to the clients, with this week alone over 340,000€ having been awarded.

Over the next 30 days, CLA have informed Inside Timeshare of the number of trial and pre-trials they have in various courts around Spain, it is a staggering 101! That is certainly keeping the judicial system busy.

Their execution of sentence department headed by Cristina Batista and Judith Diaz Pascual, have filed “provisional executions”, with a total worth of over 6 million euros against all major timeshare resorts. The total value is over 6.000.000,00 € and is against all of mayor timeshare resorts.

These execution orders are made in the interests of the clients and ensure that the resorts payout what they have been ordered to.

I previously wrote about a positive timeshare sales presentation I attended not long ago in Sedona, Arizona. I mentioned that my Diamond Resorts sales agent and manager expressed shock and dismay at the misrepresentations we told them we experienced at a November 18, 2016 Virginia sales presentation. The Sedona agents stated that they were appalled and determined they would go to bat for me by contacting headquarters. I was asked to write out my complaint. Wary but hopeful, I waited. As expected, nothing happened.

To recap what happened at the 2016 Virginia presentation, we attended a member update hoping to learn about how to get rid of 11,500 timeshare points we had previously purchased. After several hours our sales agent had an epiphany. He recalled a new program that would give us the option to sell ALL of our points back to Diamond Resorts! We listened to three more hours of this agent’s version of Grimm’s Fairy Tales. After the sixth repetition, we became convinced this program existed. He told us, (and wrote down on a paper), a figure of $108,000 which was the amount he said we should be able to sell our points back for in three years. While I presently cannot locate the paper with $108,000 written on it, I do still have this agent’s “pencil pitch” indicating a “value” of $72k ($72,420 to be exact if you multiply the 8,500 points proposed times $8.52 per point). A formal proposal containing the exact numbers was presented, but that document is proprietary so we cannot present in this article. Diamond will argue that $8.52 per point represents “retail” not “resale” value, but I contend not disclosing Diamond points are virtually worthless is a material omission. Licensed timeshare brokers I contacted, who do not charge upfront money to list timeshare points, will not accept a listing for Diamond points.

Diamond Resorts has launched a program called CLARITY™ promising clear, concise, transparent and accountable information.  This is what I was provided:

At the bottom of this unclear pencil pitch, you see “G 2” and “S 3”, and below that ‘Loyalty 3 ys’. This meant that in 3 years we would have earned enough loyalty to sell the points back at a handsome profit. If we became Gold, we could sell back in two years. According to the sales agent, this new buyback policy was not available to mere Standard members like us who owned less than 15,000 points. We agreed to buy 4000 points for $15,500 to become coveted Silver members in order to qualify for the buyback program.

When I complained to Diamond I was told I did not have sufficient written evidence. I made up G2 and S3?

I remember asking the sales agent how Diamond could afford to offer a $108,000 buyback which could have exceeded our cumulative purchase price plus maintenance fees. He mentioned investment returns Diamond makes on sales. As an MBA and a CFP this made sense to me, as it made sense to George Yamada, a pension administrator who purchased Diamond points thinking he was making an investment. George is an Army veteran, Agent Orange disabled.

It appears I was not the only member excited about how this ingenious new buyback program was going to make their product more attractive to buyers. The sales agent, Mark Wilkerson, no longer works for Diamond, but he explained the program as a brand new Apollo related deal. Apollo Global Management, a private equity firm, acquired Diamond Resorts.

Does Diamond think I would go to this much trouble if I was making this up? Under threat of perjury, I have filed a complaint with the Virginia Attorney General’s office that has been under review.

Unfortunately, I do not possess a video tape of the presentation. This has prompted me to volunteer to be our Secret Shopper Coordinator. I’m on a media binge to warn other timeshare buyers to RECORD THE SALES SESSION! This is legal in Virginia as Virginia, like some other states, is a one party state. I feel this is the only road to true clarity.

Not only did we pay $15,500 for nothing, we incurred additional ongoing maintenance fees and $2,250 in income taxes on a retirement distribution I had to make to pay for the purchase.

I asked for the contract to be cancelled and my down payment refunded. I am asking nothing for my permanent loss of faith in humanity. Like several members of our 2,400 member sponsored Diamond Facebook page, I am disabled. My sole source of income is my SSI disability income. I have learned from our Facebook other timeshare companies also respond to complaints with, “We are not responsible for what our sales agents say,” and “You signed a contract.” I received a certified letter from Diamond’s legal department (Consumer and Regulatory Affairs Officer) asking for written evidence. I provided the pencil pitch above, but even that does not break through the oral representation clause.   

Timeshare sales agents are not supposed to deviate from company approved sales strategies, but complaints from timeshare buyers continue to flood the internet, Attorneys General offices, the Better Business Bureau and other regulatory agencies. With little enforcement, we feel members need to take matters into their own hands by becoming Secret Shoppers so we can evaluate for other members how near or far a timeshare sales agent ventures from his or her script.

We have about a dozen Secret Shoppers. We arm our Secret Shoppers with intelligent questions timeshare buyers often forget to ask. It is our hope we can publish some positive Secret Shopper experiences. After compiling over 500 timeshare complaints, we have determined the most popular complaints involve:

  • Maintenance fee relief programs that do not exist,
  • The ability to sell points or weeks when there is no secondary market,
  • Misrepresenting the value of using a credit card to offset maintenance fees,

My father was a Navy veteran, but I did not grow up hearing about war stories. It wasn’t until Inside Timeshare started hearing from veterans and active duty military service members and law enforcement reaching out to us, that I heard war stories of heroism that left me in awe.

That’s not my father pictured above. It is the actor Glen Ford. My dad served in the Navy with Glen Ford. Dad always said he had the best job in the Navy. He was a cook for the nurses until his medical discharge for ulcers. He enlisted at age 36, called to the cause. Many Thanksgiving dinners were ruined because of too much salt in the dressing and when he cooked chili or shrimp, it was always enough for a barracks. He once told me he was in the monkey cage at the San Diego Zoo. “You mean at the monkey cage,” I asked? “No, I was IN the monkey cage. They turned the monkey cage into an infirmary.”  

I started hearing about accounts of heroism when veterans who purchased timeshares started asking for help. Army veteran Leo Gomez contacted me. He was worried about an outstanding timeshare loan. After listening to Mr. Gomez, I said I did not hear any deception so he would in all likelihood be responsible for the loan. That night something bothered me. I called Leo the next morning and asked WHY he changed from one program to another. His reply was more than enough assurance to convince me that he had been lied to, especially since he did not KNOW he had been lied to. I asked if the sales agent knew he had pancreatic cancer, likely a result of Agent Orange exposure. He said yes because he was tired from the aftereffects of treatment. The company did resolve his issue, but with hours left to live, Leo’s wife called distraught, saying the credit card company was calling demanding to talk to him, demanding the $4,000 down payment. Leo passed away November 2, 2018.

Leo earned two Purple Hearts.

From Marine veteran Raymond Mori

Mr. Mori’s daughter Teresa also contacted me distraught. Despite being timeshare members for years, they were sold a trial program. As the bills mounted, Teresa delved into their contracts.  She called the timeshare company and asked that the trial program be cancelled. Teresa said the timeshare customer service agent said they would have to talk to her dad. She said they “fixed” it by selling them 17,000 additional points for $49,492.

Mrs. Mori called me one day. What she described as Mr. Mori’s symptoms sounded like the symptoms experienced from a type of blast syndrome that causes brain changes that contribute to flashbacks and symptoms associated with PTSD. Mrs. Mori had explained that for years Mr. Mori woke up with horrific memories. He had spent over five months in a diabetic coma.

Teresa decided to attend a sales presentation at their resort to see what would happen. She said the sales agent attempted to sell her mom and dad $234,000 in additional timeshare points at age 83, while Mr. Mori was dozing off in his wheelchair, possibly a side effect from prescribed drugs.

George Yamada, disabled from Agent Orange, paid US Consumer Attorneys $6,000 to get out of his timeshare contract. We helped him for free. George works as a pension administrator. He bought points he said were sold as an investment. After I suggested George file a complaint with the Securities and Exchange Commission, his loan was terminated.

These are only three of our veteran complaints. Of the 81 military and law enforcement timeshare members that have reached out to us, 55 are veterans. Of the 55 veteran complaints, 22 resolved their dispute, but not without losing money.

Several of our veterans were scammed by a timeshare exit company. We helped one 100% disabled Agent Orange exposed Army veteran, who was up-sold by a sales agent we have 17 complaints against, resolve his IRS issue. He was issued a $170,000 1099 tax liability form, but we were able to provide him with the information he needed to get this reversed. The timeshare exit company in Branson was of no help.    

I listen to members and type the member’s account as we talk, as they explain what went wrong with their timeshare. We have a list of contacts their complaints can be sent to.

Some states will investigate based on a volume of complaints, but other states seem to walk lock step with the timeshare developer and reply to all complaints filed with, “You have no proof.” In those states, timeshare sales agents can say anything, based on responses from 514 timeshare members.

Of course, there are honest timeshare sales agents. They too are harmed by the actions of predators.

They included our report on unfair and deceptive timeshare sales practices in their report to the Joint Committee on Veterans Affairs presented March 14, 2018. Veteran stories are humbling. Several developers have worked WITH us instead of against us, but they are companies that will listen to the merit of a complaint rather than auto-dismiss with “You signed a contract” or “We are not responsible for what our sales agents say.”    

Veterans Day was Sunday, but there is never a day we should not remember our veterans.

Thank you Irene for this account, it is horrific that people who have given their all should be treated in this way, just to satisfy the greed of some sales agents with the complicity of their employers.

The timeshare industry needs to change, it is they and they alone who are destroying what should be an industry that promotes happiness, fun and family memories, especially for those who have served.

Friday’s Letter from America

Welcome to this week’s Letter from America, it is yet another “Nightmare on Timeshare Street” by Irene Parker involving yet another Veteran, this story is on that will make your blood boil! But first for some news from the Spanish Courts and more disasters for the timeshare industry.

Anfi were yet again on the receiving end on the 18 September, They had to deposit into the court the sums of 48,735.82€ and 16,222.68€ in respect of sentences issued in the favour of clients. In two days that brings the sum Anfi have had to payout to a massive 184,650.14€.

On the same day, the Courts of First Instance in Masàlomas issued another sentence against Anfi, at the same time in Tenerife, Silverpoint had two sentences issued against them. In all the total awarded is a massive 215,000€. All contracts were declared null and void and all clients received back double the deposit paid which was in breach of the law forbidding the taking of payments within the cooling off period. One of the sentences against Silverpoint was issued by the High Court in Tenerife.

In another case which was held last week, the Judge at the Court of First Instance number 5 in Arona, decided that the case would not be sent for a full trial, he decided that as the case was in flagrant breach of the timeshare laws, he would issued the sentence in due course. On 19 September that sentence was issued, the contract with Silverpoint was declared null and void, with the client being awarded more than 23,000€.

Good news also came from the Courts of First Instance in Maspalomas, The judge presiding over Court Number 3 had several pre-trials this month, he then decided that these cases need not go to a full trial and he would issue sentences in due course. That now make Courts numbers 1, 3 and 4 no longer sending cases for a full trial, this is obviously good news for the clients bringing the cases as it now speeds up the judicial process.

All these cases were brought on behalf of clients from none other than those determined lawyers at Canarian Legal Alliance, so congratulations the lawyers and their clients.

One of our readers contacted Inside Timeshare to inform us that an ex sales Rep from Silverpoint had cold called them regarding getting them out of their Silverpoint contract with a view to gaining compensation. How did our reader know he was an ex-sales rep, simple, he was one of those that sold them the Silverpoint in the first place! The Caller stated he was from Harlow Consultants SL, so another new company has appeared.

A Fourth Vietnam Veteran, Agent Orange Disabled, Fights a Timeshare Battle

Inside Timeshare has heard from 587 U.S. timeshare members, all but a handful alleging unfair and deceptive trade practices. Of the 587, 78 are veterans, active duty military and law enforcement. Many of the vets are disabled. Four, like Mr. Gomez, are disabled from Agent Orange. The volume of timeshare complaints submitted by readers has established the following facts and opinions:

  • Fact – Many of the 584 families are financially devastated by their decision to buy a timeshare. I have listened to many tears.
  • Fact – All but a few complaints have been dismissed with, “You signed a contract” or “Verbal representations are hard to prove.”
  • Fact – All the complaints sent to the Nevada Real Estate Division and the Florida Timeshare Division, DBPR, have been met with the above defenses.  Other states have taken complaints seriously, based on the volume of complaints and the similar nature of the complaints.
  • Fact – There are several repeat offending sales agents, with three to six identical or similar complaints.     
  • Fact – Not one of the 584 families knew their timeshare had virtually no secondary market.
  • Fact – A significant number have been ripped off by a timeshare exit company.
  • Opinion – Lawyers with no timeshare experience have no business taking a timeshare case.
  • Fact – The dollar amounts of many complaints lost to timeshare exit scams pales in comparison to the dollar amounts lost believing timeshare sales agents, according to member reports.

One resort has accused me of creating complaints. In other words, if the member had not talked to me, they would not have had a complaint. In the case of Mr. and Mrs. Gomez, this is true. I’ll explain. We will not name the timeshare company, hoping they will help the family, but the Gomez family said they would like their story told. Mr. Gomez is 71, Mrs. Gomez 63. They are Arizona residents.

Like George Yamada, from last week’s article, Mr. Gomez is a Vietnam Veteran, disabled from the effects of Agent Orange.

Mr. Gomez is 100% disabled. Mr. Gomez earned two Purple Hearts. He has been informed his pancreatic cancer is terminal.

Mr. Gomez called a week ago and said he was struggling with a $28,000 timeshare mortgage. After listening to his comments, I concluded there had been no deception. A timeshare mortgage is just like a home mortgage in that you can’t go to your home mortgage lender and say, “I can’t afford this.” Mr. Gomez said he had switched some old points into a newer category of points. At the end of our conversation Mr. Gomez mentioned his Stage 4 pancreatic cancer. I advised him to request a release based on medical hardship.

That night I woke up with one of those lightning bolt 2 A.M. moments. I called Mr. Gomez first thing the next morning and asked WHY had he switched from the old points to the new? He said it was because his resort had gone bankrupt.

I know for a fact that it is not mandatory to switch from his old points to the new. Mr. Gomez went on to tell me the sales agent in Las Vegas knew he had pancreatic cancer because he had explained to the agent why the four hour presentation was so tiring. He was suffering the aftereffects of his treatment. “They said our maintenance fees were $2,200 for 2018 and would go up to $3,000 January 1, 2019 if I did not convert, but if I upgraded to the next loyalty level I could turn in 10,000 points to pay $2,000 of the $2,500 maintenance fee,” he added. This is nonsense of course.  Mr. Gomez’s maintenance fees will go up more than $2,500 because of the additional points he purchased. Maintenance fee invoices have not been sent, but I seriously doubt the increase in his prior points will increase this dramatically. I own the same points.

So yes, you could say I created this complaint. Without my informing Mr. Gomez it was not necessary to switch from one set of points to the new, he would not have been aware of the deception. Only at the highest loyalty level can maintenance fees be paid with points (at pennies on the dollar).    

Whether this complaint is resolved or not resolved, it doesn’t change the turmoil this timeshare has caused the Gomez family by believing they had to transfer from one program to another. Mr. Gomez has been accepted for Hospice.

Mrs. Gomez called me. I had already surmised Mr. Gomez is an easy going person. His reaction seemed more disappointment than anger when I told him he could have kept his prior timeshare with the $6,000 loan balance, as opposed to the $33,000 purchase with $28,000 financed and $4,500 charged to a credit card. Mrs. Gomez reaffirmed my suspicion of Mr. Gomez’s easygoing nature saying,

Leo is a very easygoing person. But I’m a teacher!” A common complaint we hear, “I don’t like being made a fool of.

We encourage member accounts of their timeshare experiences, good or bad. We hope consumers and the industry will listen to the voices of those who wish to be heard.

So there we have it, another “Nightmare on Timeshare Street”, this is probably one of the worst that we have yet come across, it makes you wonder if these sales agents and company directors have any moral bone in their bodies.

Timeshare Author Challenges Diamond Resorts CEO Flaskey to “Do The Right Thing.”

I am not sure how to react when Mike Flaskey, CEO of Diamond Resorts International, views my profile on LinkedIn.

But, whatever his reason, I would like to share a few words with him, now that I have his executive attention.

My purpose in writing the book is not to attack companies such as Diamond to gain something in my own corner. I am merely pointing out areas that I feel require your attention to improve on customer relations.

These areas have certainly been highlighted with the multi billion dollar lawsuits against Diamond Resorts, and the level of customer dissatisfaction from the people who befriended and trusted your OPCs, sales reps, and VLOs. Remember, your members are the people who provided you the privilege of representing a company that has so much potential.

Rather than spend millions of dollars hiring fancy lawyers to help improve on customer service, you hire them in an attempt to destroy a woman in her 70s who is spending the remainder of her life helping families get their lives back on track for the damage your company has allegedly caused.

Shame on you, Flaskey for focusing on how to keep afloat your ship while the likes of Marriott and Disney and other reputable resort chains are watching you.

I am asking you to “man up,” and be the leader that your company and the general public can respect and appreciate by “doing the right thing.”

Spend your money and time trying to improve your customer relations and presenting your company as something Americans can be proud of, or find somebody else who can do the job.
