Start with the FBI if a victim of a “bait and switch”

Inside Timeshare has received 238 US timeshare complaints (135 since our last complaint form revision 9/17). An escalation in the criminal nature of allegations, especially, voiced by nine active duty and retired military, led us to the FBI. If your timeshare experience has met the FBI’s definition of white collar crime, financial institution fraud, the FBI’s appropriate guidelines are described below. I followed their recommendations after speaking with two FBI intake workers and two FBI agents over the past year. According to the FBI website,

White-collar crimes are characterized by deceit, concealment, or violation of trust and are not dependent on the application or threat of physical force or violence. The motivation behind these crimes is financial—to obtain or avoid losing money, property, or services or to secure a personal or business advantage.

These are not victimless crimes. A single scam can destroy a company, devastate families by wiping out their life savings, or cost investors billions of dollars (or even all three).

Mortgage fraud (which is the option timeshare buyers fall under) is a subcategory of financial institution fraud known as “fraud for profit”:

Fraud for profit: Those who commit this type of mortgage fraud are often industry insiders using their specialized knowledge or authority to commit or facilitate the fraud. Current investigations and widespread reporting indicate a high percentage of mortgage fraud involves collusion by industry insiders, such as bank officers, appraisers, mortgage brokers, attorneys, loan originators, and other professionals engaged in the industry. Fraud for profit aims not to secure housing, but rather to misuse the mortgage lending process to steal cash and equity from lenders or homeowners. The FBI prioritizes fraud for profit cases.

“The 3Rs or F of Timeshare” allowing the beleaguered timeshare member to put a bad decision in the rear view mirror are:

  • Resolution
  • Relinquishment
  • Refund
  • Foreclosure

The most common complaint:

The backend of timeshare fraud has been widely reported, but there has been little attention paid to the front end. This US Department of Justice timeshare scam report details the extent of the fraudulent resale industry. Many of our Advocates feel the front of the timeshare sale contains a comparable level of criminal activity, based on 223 of our 238 complainants alleging they were victimized in a way that meets the FBI definition of financial institution fraud.

If your investment is $40,000 or less and you owned and used your timeshare for ten years or more consider relinquishment.

Complaints expressing dissatisfaction with general availability will go unheeded, as will a request based on not being able to afford the timeshare. The FBI complaint should be filed only if there are credible allegations of deceit and bait and switch.

MOST IMPORTANT – Purchase Timeline

It is better to state your narrative as a narrative referring back to the contracts and figures at the top of your complaint. Begin with when you first became involved with the company and proceed chronologically. Keep your history brief up to the point when things began to go wrong.

The most common allegation is bait and switch. If you feel you were deceived, list the reasons why.

How Advocacy Works

After you complete your complaint, email it to the appropriate resort department. Expect to be denied. Typically your resort reviewer will restate your concerns, produce your initials and signatures, point out the oral representation clause or inform you, “If something was important to you, you should have asked for it to be put in the contract.”  They may conduct an investigation and report back that the sales agent(s) denied your claims. File a rebuttal if you disagree.

Depending on the nature of your complaint, especially complaints directed against an agent with multiple complaints on file, an Advocate may file your complaint on your behalf with the firm’s public relations office and ARDA, the timeshare lobby, for violating ARDA’s Code of Ethics. ARDA’s Code of Ethics can be found on ARDA’s website. We do not recommend owners make the voluntary opt in or opt out ARDA ROC contribution on your maintenance fee invoice for ARDA ROC (Resort Owners Coalition). ARDA is basically a PAC that lobbies for the industry when the issue is one that is at odds with members. We will also inform NTOA (National Timeshare Owners Association) and the bank that financed your loan or issued a credit card through the Consumer Protection Bureau online complaint form. By having the Advocate file on your behalf, we can track complaints, documenting patterns of criminal behavior.

Mark your email to the resort urgent if you are in financial distress. It is best to file a complaint before the debt collectors are hounding. It may take up to 30 days to hear back from the resort. If you feel you were a victim of deceit and bait and switch, give the resort a week to respond before filing regulatory complaints.

The member will report back to us with a positive or negative outcome. Due to the required non-disclosure or mutual release form, terms and conditions will not be discussed. Just report a positive outcome or resolution.

Once the resort denies your claim begin filing complaints with regulatory and law enforcement agencies beginning with the FBI if you feel you meet the definition of white-collar crime. There are three ways to report to the FBI. We recommend calling the nearest field office after filing with IC3.gov. Filing online will help you organize your thoughts.

The FBI assigns Financial Institution Fraud the highest priority.

The next step is to file a complaint with the Attorneys General of the state where you signed your contract, where you live and where your resort is domiciled. It can take a month or more to hear back from an AG, but once your complaint has been accepted, debt collectors are not allowed to call. You can find any Attorney General by searching the state name and Attorney General.

If there was an unauthorized credit card charge or you feel you were deceived into signing off on a loan, you should file with the Consumer Financial Protection Bureau under the mortgage option (even if no mortgage) and select the bank that financed your loan or issued a credit card. One common complaint is that the buyer was told they could get a lower interest rate from a bank or credit union. File with the CFPB only if there is a loan outstanding or a credit card was used.

You should file a complaint with the state Real Estate Division in the state where the agent is licensed if your complaint is against a sales agent. The Advocate can help you if you don’t know the agent ID number. Timeshare sales agents are real estate licensed in most states.

File with the Better Business Bureau, although the company’s BBB rating can be misleading in that the BBB only rates how efficiently a company responds to complaints.

Most importantly, consider reaching out to local or national media. Reporters look for content and are surprisingly easy to reach. Write an article about your experience. The more people who come forward, the more the public is made aware of pitfalls before engaging in a timeshare sales presentation.

Summary of Regulatory and Law Enforcement Agencies

  • The FBI at IC3.gov portal, if you feel you were deceived by a bait and switch, and then contact your nearest FBI field office to file an oral tip.
  • Attorneys General where you signed, where you live and where the resort is domiciled. Most AG complaints can be filed online.
  • The Real Estate Division of the state where the agent is licensed, if your complaint is against the agent. “Right-to- use” membership programs are not defined as real estate, but the agent is typically a licensed real estate agent.
  • ARDA if you feel ARDA’s code of ethics has been violated.
  • The media – the court of public opinion is often the only court available. Inside Timeshare, published in Spain, publishes timeshare articles online focusing primarily on the need for reform and oversight.
  • The Consumer Financial Protection Bureau under the mortgage option, selecting the bank that issued the travel credit card or financed your loan.
  • The Federal Trade Commission – due to lack of secondary market
  • The Better Business Bureau
  • Lawmakers – The problem is the timeshare buyer typically does not buy in their state of residence, which is why lawmakers don’t seem to take timeshare seriously. Still, any effort to contact lawmakers is encouraged.

If this sounds like a lot of work, it is, but you can file with some, all, or none of the agencies. We feel “Action and Advocacy” is the way to change questionable timeshare business practices. Change requires volumes of complaints.

If you are granted a positive outcome, you may not say or write anything disparaging about the resort, but there is no harm in staying involved by referring timeshare members to Inside Timeshare.

Who We Are and Why We Do This

The timeshare industry is wealthy and powerful, able to influence politicians and Attorneys General. Timeshare owners typically are struggling with maintenance fees, unorganized and alone. Venting on complaint sites has no effect whatsoever.

There are a number of timeshare members and non-timeshare member advocates working behind the scenes to assist in the complaint process. If all else fails, we will refer an attorney if the member can afford one. If you are forced into foreclosure, but have an otherwise unblemished credit report, you can write to the credit reporting agencies in an effort to explain why you were deceived and why you were not able to resolve your dispute.

After retiring from Edward Jones working as an Investment Representative, I worked three years as a CASA supervisor, writing and editing court reports for Family Court on behalf of foster children. I find two commonalities between children of abuse, neglect or dependency, and deceptive timeshare sales.

  1. The abnormal becomes the normal. After hearing 238 complaints, we fear deception is endorsed and encouraged by some timeshare companies. I have interviewed twelve current and former timeshare sales agents and managers. I’m told making false claims is called “pitching heat” or “No Heat, No Eat”. Of course not all sales agents are dishonest. We hear primarily from buyers seeking assistance when victimized by unscrupulous agents. Inside Timeshare endorses Disney because of their scarcity of complaints.
  2. Victims are silenced and isolated via non-disclosure agreements and arbitration. Encourage those considering the purchase of a timeshare to opt out of arbitration. This must be done normally within thirty days of signing the contract. Non-disclosure is appropriate in the case of a settlement, but when a family receives nothing after an alleged bait and switch, after spending $5,000 to $500,000 or more on a vacation plan, not allowing the victim to say anything disparaging about the company seems harsh. We receive many calls about this clause.  

There are many who use and enjoy their timeshare. My husband and I owned three timeshares for 25 years with no problems or complaints. After we attended a pathetically aggressive sales presentation in 2015, I began researching the industry, writing articles and assisting timeshare victims. I am not compensated by anyone. Our Advocacy group is composed of volunteers. We hope there will come a day our Advocacy Group is not needed.

Self-help groups seek to provide members a way to proactively address membership concerns; to advocate for timeshare reform; to obtain greater disclosure from the company; to advocate for a viable secondary market; and to educate prospective buyers.

The Tuesday Slot with Irene, Plus some news about Butlins.

In this Tuesday’s article by Irene Parker, she explains how timeshare members fight back, this is a rather timely piece as we have recently received some disturbing news. It would appear that not is all well at Butlins.

In previous articles we praised Butlins Blueskies timeshare as one that was sold correctly and seemed to have very few complaints from members. That had now changed, Butlins is ending Blueskies.

According to some of the posts on the Blueskies, Butlins, members facebook page, members are not happy about losing their timeshares. They were told that if they did not accept the offer to terminate the club, then their maintenance fees would rise significantly.

According to some of the posts on the facebook page, Butlins have also been hiring out apartments to non members, which goes against what they were sold. One member posted the following:

“Blueskies was sold to most of us as an exclusive club, it was not to be hired out. Therefore Butlins Blueskies broke the contract with us as members when they started hiring apartments out without asking/informing us the members.”

It also looks like there are many complaints about the standards of the apartments and the service, that everything seems to have gone down hill. Repairs not being carried out, with comments on damaged floor tiles and windows.

But the vast majority of the comments surrounded the vote, which gone in Butlins favour and the club is to be wound up. It also appears that the vote was done on points, rather than just votes, the more points, the more votes. Which makes the vote in Butlins favour not surprising, as they will own the points not sold. We have seen this before at other timeshare resorts, where the vote has gone in favour of the developer or management company.

Many members are calling to band together and take legal action, as they feel they have been cheated. It is a sad day when a company like Butlins, which did have a relatively good reputation in the timeshare industry suddenly falls from grace. We wish the members all the best in their fight to right a wrong.

A timeshare insider recently asked me, “Why is Timeshare Advocacy Group™ so successful?”  “How do you do it?”

Most timeshare members contacting Inside Timeshare and timeshare advocacy Facebook pages are confused, angry, and overwhelmed. Members face a battle pleading with a timeshare company, demanding a refund or loan be cancelled, knowing they may be forced into foreclosure if they are denied. If the member feels they were sold or up-sold by deceit, the conflict is magnified. The automatic denial from the resort leads to more anger and frustration as rebuttals ensue. We take pride in the number of members we have steered away from fraudulent transfer companies charging hefty amounts for so called guaranteed exits.

Something clicks inside a person when they have had enough, be it a victim of domestic abuse, child abuse, or predatory timeshare sales. Our goal is to turn the sound of the caller’s scared and desperate voice into a confident voice by providing the member with the resources needed to take action and advocate.

Eron Grant is an educator who has volunteered to be our “go to” person analyzing ARDA’s Code of Ethics. After a member submits a report to us, Eron identifies how a timeshare developer has violated ARDA’s Code of Ethics. The report is forwarded to ARDA’s General Counsel and Lobbyist. So far there has been no response. We feel if an organization says they have a Code of Ethics, the Code should be enforced. Advocacy groups have been encouraging timeshare members not to make a voluntary donation to ARDA ROC, feeling the $4 to $5 million a year raised is used to lobby against timeshare owners when an issue is at odds with developer interest. It’s doubtful most owners know what the letters ARDA ROC stand for.

“Owners donated $5.5 million this year, through voluntary contributions on their maintenance fees, to support ARDA-ROC, the independent Resort Owners’ Coalition that teams up with ARDA on consumer and legal issues that impact owners. The top two givers were owners at Diamond Resorts and Bluegreen Vacations, each of whom contributed $1 million for ARDA’s representation.” RedWeek April, 2017

According to Dr. Amy Gregory, University of Central Florida, who presented at an ARDA World Conference,

“A whopping 85 percent of all buyers regret their (timeshare) purchase (for money, fear, confusion, intimidation, distrust and other reasons). Forty-one percent of buyers never thought they would regret their purchase, but they did; another 30 percent were neutral prior to buying, but then regretted it.”

ARDA worked to pass legislation in Florida making it more difficult for timeshare members to be released from contracts due to non material errors. A high percentage of buyer’s remorse, coupled with a perpetual contract, little or no exit, and rising maintenance fees have left frustrated timeshare members no place to turn in an industry that is virtually unregulated. Lawmakers, influenced by lobby dollars, turn a deaf ear. Advocacy groups were outraged by the Florida bill.

Karen Garello is our Secret Shopper coordinator. Karen is one of several members who allege they did not know, until they returned home, a credit card had been used to purchase a timeshare product. Marsha Young also was unaware she had been charged for the same timeshare product, but Marsha received her money back, told the person who sold it to her had been fired. The resort said he had been the top selling agent of this particular product.

Inside Timeshare and Timeshare Advocacy Group™ developed a step-by-step plan a member can follow if a resort offers no assistance. Through regulatory filings and media outreach members are helping other members while also contributing to timeshare reform. Other advocates, working behind the scenes, focus on legislative actions. Time, patience and diligence are necessary.

Many of the members reaching out to us have health issues. Out of 166 complaints received, diagnoses include cancer, dementia, concussion, kidney disease, Bell’s palsy, financial loss caused by loss of employment or divorce, and grief over the loss of a spouse or loved one. Developer attorneys say hardship is not a legal defense.

Many life events cannot be foreseen, so consumers thinking about buying a timeshare need to think about whether it is prudent to buy anything for $25,000 to over $500,000 that does not have a secondary market, is perpetual, and is accompanied by rising maintenance fees. Some timeshares have a limited secondary market. Members of the Licensed Timeshare Resale Broker Association can give you an idea of what your timeshare may be worth on the secondary market.

Inside Timeshare has received many complaints (157 out of 166) by timeshare members alleging they were deceived on the front end of the timeshare sale. We are learning there are many ways to dodge the rescission period.

Timeshare member Tammy Arkley only realized this happened to her because she was able to access the booking site because her friend was already a member at a higher loyalty level. Tammy said she was told she would need fewer points to book stays if she upgraded to the next loyalty level, but when she went back to her room and logged onto her friend’s account, already at that loyalty level, she saw the reservation took the same exact number of points. She received her money back, but what did this experience do to change the image she had of this company?

In other words, there are some promises and claims that cannot be discovered until the buyer has access to the booking site, long after the cancellation period.

Similarly, others have been told they would need to wait six months before selling points after upgrading to the next loyalty level. By placing a six month wait on the false claim, the complaint is old when reported. Too many of our readers are highly educated professionals and were not alone when they attended the presentation. There are so many almost identical complaints – we can sometimes guess the name of the sales agent.

Timeshare members have had enough. Social Media now allows timeshare members to contact other members to find out they are not alone. Members include professionals offering their skills to help other members. We are hoping one day, if the timeshare companies themselves will not acknowledge the problems, lawmakers will pay attention.

My husband Don, and first read editor, asked me as I was writing this article, “Why does Disney have so few complaints?” Disney, I said, is a company backed by generations of little critters enmeshed in a corporate culture and brand that will not allow deceit but does allow a secondary market. It does not seem to have hurt their bottom line. Zacks estimates a year over year growth estimate of 11.27% forecasted for 9/20/2018 with an impressive 1.66% allowance for doubtful receivables 10/1/2016.

We now share some more news from the courts in Spain, the High Court in Tenerife yesterday announced another crippling verdict against Silverpoint. The judge has declared another client’s contract null and void, ordering the return of over £40,000 plus legal interests. Once again the courts are finding in favour of clients as per the rulings of the Supreme Court.

So no matter what the industry claims, they are losing the battle, consumers are protected by the law, at least as far as timeshares sold in Spain are concerned. It now needs the rest of Europe to follow suit, giving the protection that the EU Timeshare Directives promised. The industry must acknowledge the fact that they have for too long run roughshod over consumers in their quest for easy money.

If you feel you are a victim of deceit and bait and switch, send us a copy of your complaint. An Advocate will file your complaint on your behalf with the firm’s public relations office and ARDA, the timeshare lobby, for violating ARDA’s Code of Ethics which can be found on ARDA’s website. We do not recommend owners make the voluntary opt in or opt out contribution on your maintenance fee invoice for ARDA ROC (Resort Owners Coalition). ARDA is basically a PAC that lobbies for the industry when the issue is one that is at odds with members. We will also include NTOA National Timeshare Owners Association and the bank that financed your loan or issued a credit card. By having the Advocate file on your behalf, we can track complaints, documenting a pattern of criminal behavior.

Mark your email urgent if you are in financial distress. It is best to file a complaint before the debt collectors are hounding. It may take up to 30 days to hear back from the resort. Resend in three weeks if you have not heard back. If you feel you were a victim of deceit and bait and switch, give the resort a week to respond before filing regulatory complaints.

The member will report back to us with a positive or negative outcome. Due to the required non-disclosure or mutual release form, terms and conditions will not be discussed. Just report a positive outcome or resolution.

If your resort denies your claim begin filing complaints with regulatory and law enforcement agencies beginning with the Attorneys General of the state where you signed your contract, where you live and where your resort is domiciled. It can take a month or more to hear back from an AG but once your complaint has been accepted, debt collectors are not allowed to call. You can find any Attorney General by searching the state and Attorney General.

If there was an unauthorized credit card charge or you feel you were deceived into signing off on a loan, you should file with the Consumer Financial Protection Bureau under the mortgage option (even if no mortgage) and select the bank that financed your loan or issued a credit card. One common complaint is that the buyer was told they could get a lower interest rate from a bank or credit union. File with the CFPB only if there is a loan outstanding or a credit card was used.

You should file a complaint with the state Real Estate Division in the state where the agent is licensed if your complaint is against a sales agent. The Advocate can help you if you don’t know the agent ID number. Timeshare sales agents are real estate licensed in most states.

File with the Better Business Bureau, although the company’s BBB rating can be misleading in that the BBB only rates how efficiently a company responds to complaints.

The definition of Financial Institution Fraud under the FBI’s definition of White Collar Crime is “deceit, concealment, violation of trust and bait and switch”. The FBI assigns Financial Institution Fraud the highest priority. You can read about White Collar Crime on the FBI website, but complaints are filed at IC3.gov. This is somewhat confusing because IC stands for Internet Crime and people think it has to be internet related. IC3.gov is just the name of the portal.

Most important, consider reaching out to local or national media. Reporters look for content and are surprisingly easy to reach. Write an article about your experience. The more people who come forward, the more the public is made aware of pitfalls before engaging in a timeshare sales presentation.

Summary of Regulatory and Law Enforcement Agencies

  • Attorneys General where you signed, where you live and where the resort is domiciled. Search (state name) Attorney General for contact information. Most AG complaints can be filed online.
  • The Real Estate Division of the state where the agent is licensed if your complaint is against the agent. “Right-to- use” membership programs are not defined as real estate, but the agent is typically a licensed real estate agent.
  • The FBI under the IC3.gov portal if deceit or bait and switch.
  • ARDA if you feel ARDA’s code of ethics has been violated.
  • The media – the court of public opinion is often the only court available. Inside Timeshare, published in Spain, publishes timeshare articles online focusing primarily on the need for reform and oversight.
  • The Consumer Financial Protection Bureau under the mortgage option selecting the bank that issued the travel credit card or financed your loan.
  • The Federal Trade Commission – due to lack of secondary market
  • The Better Business Bureau
  • Lawmakers – The problem is the timeshare buyer typically does not buy in their state of residence which is why lawmakers don’t seem to take timeshare seriously. Still, any effort to contact lawmakers is encouraged.

If this sounds like a work, it is, but you can file with some, all, or none of the agencies. We feel “Action and Advocacy” is the way to change questionable timeshare business practices. Change requires volumes of complaints.

Who We Are and Why We Do This

The timeshare industry is wealthy and powerful, able to influence politicians and Attorneys General. Timeshare owners typically are struggling with maintenance fees, unorganized and alone. Venting on complaint sites has no effect whatsoever.

There are a number of timeshare members and non-timeshare member advocates working behind the scenes to assist in the complaint process. If all else fails, we will refer to an attorney if the member can afford one. If you are forced into foreclosure, but have an otherwise unblemished credit report, you can write to the credit reporting agencies in an effort to explain why you were deceived and why you were not able to resolve your dispute.

After retiring from Edward Jones working as an Investment Representative, I worked three years as a CASA supervisor, writing and editing court reports for Family Court on behalf of foster children. I find two commonalities between children of abuse, neglect or dependency and deceptive timeshare sales.

  • The abnormal becomes the normal. After hearing 136 complaints (as of September 5), I fear deception is endorsed and encouraged by some timeshare companies. I have interviewed nine current and former timeshare sales agents and managers. They call it “pitching heat” or “No Heat, No Eat”. Of course not all sales agents are dishonest. We hear primarily from buyers seeking assistance when victimized by unscrupulous agents.
  • Victims are silenced and isolated via non-disclosure agreements. Non-disclosure is appropriate in the case of a settlement, but when a family receives nothing after an alleged bait and switch, after spending $5,000 to $500,000 or more on a vacation plan, not allowing the victim to say anything disparaging about the company seems harsh. Many of the families we have worked with are financially devastated.

There are many who use and enjoy their timeshare. My husband and I owned three timeshares for 25 years with no problems or complaints. After we attended a pathetically aggressive sales presentation in 2015, I began researching the industry, writing articles and assisting timeshare victims. I am not compensated by anyone. Our Advocacy Group is composed of volunteers. We hope there will come a day our Advocacy Group is not needed.

Although this article is aimed at our American cousins, the principle of how it is written will be the same for Europe. If you believe your complaint is valid, don’t give up, that’s what they want you to do, be persistent, be strong and seek help, it is out there.

In Europe the EU has set up many consumer agencies, most EU countries have consumer rights groups and Consumer Affairs offices. In the UK there are several that you could use, one which has been very good in the past is the Trading Standards Office, these are set up by local councils and have a lot of clout. They have also been instrumental in having some rather shady companies closed down.

Then there is legal action, employing a law firm to take your case to court, in Spain over the past few years this has been very successful. Law 42/98 and the updated version Law 4/12, is based on the EU Timeshare Directives, which were put into place to protect consumers and regulate the industry. Spain now has the strongest timeshare regulations in Europe, these along with other civil consumer laws protect consumers from unfair practices and contracts. These have been strengthened over the past couple of years with around 57 rulings from the Supreme Court, Spain’s highest court, which has removed any doubt about their interpretation.

It now remains for other EU countries to do the same, so no matter where you purchase, the same protection is available. We may even just see a change in the industry for the better.

Now it is August, the courts have closed down for the month, so there will be no news emanating from there. Good news for the timeshare companies! But it is guaranteed that come September there will be a flurry of sentences being announced.

It is also a time for the new “scams” to start getting ready for the Autumn and Winter season, the new company names and websites will soon be surfacing along with some of the old names that will be resurrected. Welk Resorts sues Timeshare Exit Team for Racketeering

Welk Resort of Lawrence Welk fame has sued Timeshare Exit Team for racketeering. Once again, the lack of a secondary market forces beleaguered timeshare members into the nets of alleged unscrupulous transfer agents when a resort provides no exit for members sold a timeshare contract in perpetuity.

First, a hat’s off to Lawrence Welk, a big band great that kept early American households riveted to their seats for over 20 years. To this day the Welk resort is a family friendly resort that knows how to run a business. My husband and I stayed at a Welk Resort in California. It was one of our most memorable timeshare vacation experiences.

Inside Timeshare has received a volume of reader responses alarmed that there often is no way out of a timeshare contract. ARDA and the industry have lauded timeshares evolution towards a right to use product and have stated members should not expect value back when they seek release from a right to use timeshare.

The problem with ARDA’s “see no evil, hear no evil” position is – about 90% of the complaints Inside Timeshare has received, have loans attached and many allege they were duped into signing off on high interest rate loans and credit cards. Voluntary surrender or “take-back” programs require the member be free of loan encumbrances. In addition, voluntary surrenders are never guaranteed.

Mr. Howard Nusbaum, President and CEO of the American Resort Development Association (ARDA), was quoted in a June 2014 RedWeek article in reference to the lack of a viable timeshare resale market, “This is a legacy problem. People buying a timeshare today are buying it from multisite clubs that have management forever and sales teams forever, so the ability to recycle inventory will not be a problem in the future.”

“The suit cites fraudulent racketeering activity, intentional interference with contractual relations, and violations of the California unfair competition law, California Vacation Ownership and Time-Share Act, California False Advertising Law and the state “Running and Capping” Law. The latter makes it illegal for non-attorney agents to obtain business for an attorney or law firm for compensation, or solicit others to engage in running and capping.”

Timeshare Exit Team fulfills an HOA Collections Agent’s Prediction – Previously Reported by Inside Timeshare

Kristi, a Home Owners Association timeshare collection agent I interviewed back in March of 2017, complained of lawyers transferring timeshare contracts to fictitious persons or LLCs. Some things are universal. Charles Thomas has been reporting on a recurring “Litigious Abogados” theme. Inside Timeshare is published in Spain.

As reported by Inside Timeshare in our interview with Kristi:

Irene: Are you familiar with Timeshare Exit Team? One of their agents contacted me and asked me to review their program. What is your opinion of this firm?

Kristi: I would never endorse or advise anyone to use their services ever!! They specialize and advertise “Cancellation of Timeshare Contracts” but we don’t have contracts. We have deeds. We have chosen not to do business with Timeshare Exit Team because of their inability to follow our procedures and because of the quality of work previously sent to us.

Timeshare Exit Team has been involved with two other timeshare resale companies and/or timeshare attorneys that were involved with transferring 18 of our deeds since 2014 to four individuals that have never paid the dues and are delinquent in the amount of over $18,000. Out of the four individuals we were able to track, we learned that they are all associated with each other thru business dealings, contract employees or registered agents. They must assume that the association will eventually foreclose or take the property back but it is very costly to foreclose and we do not accept property back.

Here are ARDAROC’s (Resort Owners Coalition) eight tips for selling your timeshare and how they apply or do not apply to Diamond Resort members. This is what I have learned since trying to sell my Diamond right to use points.

  • Know what you own – Most own non-deeded right-to-use points
  • Consult your resort – Diamond’s Advocacy Department has helped some members but others have had to seek legal assistance when denied relinquishment. Tracking our reader outcomes thus far – 29 out of 77 report positive outcomes.
  • Sell it yourself – member supported Facebook pages seem to be the best option, but complaints abound that “no one wants it.”
  • Get assistance from a Licensed Reseller – not one member of the 64 member Licensed Timeshare Resale Broker Association will accept a listing for Diamond’s non-deeded points due to secondary market restrictions.  
  • Pass it on or gift it to your family – maintenance fees are also passed on

  • Generate income by renting. Diamond Resorts does not allow renting through a third party website. “Use by a Member of public advertising or an online website to seek renters shall be deemed a prohibited commercial use.”

Lela Renea, a Bluegreen timeshare member, contacted Inside Timeshare about her battle with Timeshare Exit Team after they appear to have stonewalled her. Since Lela is in the middle of negotiations, she did not want to elaborate on the distress she feels, attempting to resolve her Timeshare Exit Team concerns – suffice to say she had reason to reach out to Inside Timeshare. We will be reporting as to whether Bluegreen will come to her rescue or allow her to fall to the mercy of Timeshare Exit Team.

Despite the customer loyalty and lack of complaints we reported last week among Disney deeded timeshare owners, with access to resale and rental options, right to use non-deeded timeshare programs continue to ignore the growing problems caused by perpetual contracts not able to be sold, rented or relinquished.

Welk Resorts back in the day was a fixed week timeshare but has converted to a right to use non deeded program. A life change like a job loss or illness, rendering the timeshare unaffordable, is as much a problem for members of right to use programs as it is for legacy resorts.

 We hope someday, someone in the industry or ARDA will see that throwing up roadblocks to a secondary market is a detriment for all. As we reported last week, timeshare attorney Mike Finn has never had a Disney client and it is unlikely Timeshare Exit Team has ever had a Disney client either.

Some answers are so logical and simple, they cannot possibly be understood.

Friday Letter from The US: Part II: What is our Timeshare Advocacy Group Doing Today?

Here we are again, another Friday and another letter from America, courtesy of Irene, following on from last week’s article.

Firstly the similarities between ARDA ROC and the RDO TATOC, both are industry trade bodies and owners organisations funded by the industry. Both require their members to abide by a code of ethics, but neither will arbitrate or investigate their own members. One difference is that ARDA ROC will not recommend any resale company, but RDO and TATOC will recommend any company that is one of its members.

Both bodies also actively focus on chasing scam and bogus companies, the RDO has employed kwikchex to head their Timeshare Taskforce. This company runs Timeshare Business Check, who contact businesses and question them for transparency, they list those who are not RDO or TATOC members, basically saying if they are not members or submit to their questions don’t touch them. They have no legal mandate and the owner has what can only be described as a very poor track record as a director. (see following link).

Only last week we announced and published the news that ARDA have donated $30,000 to TATOC and their Consumer Helpline, which received charitable status after initially being rejected. This donation was given because it is said they help and advise European Owners of US timeshares.

This is obviously a saving grace for TATOC as many of their members are withdrawing their membership or reducing their membership status, as was seen by Silverpoint dropping from Platinum to Silver.

Harry Taylor himself has been somewhat discredited over the Lakeview debacle, which has been going on for sometime. He has also been a very vociferous supporter of MacDonald Resorts and their forcing owners from fixed weeks into points. There is a class action ongoing by members who do not want the change as it then gives MacDonald’s “ownership” of the resorts and reduces members to “right of use only”.

This is happening in Spanish resorts, where we know that the points system is illegal, yet is still going ahead. MacDonald Resorts have a very bad reputation for the way they deal with members including the elderly. Yet they are main contributors to Harry Taylor and TATOC. Even the RDO have had nothing to do with them since 2005.

So we now move on to Irene’s article.

ARDA, the American Resort Development Association, is the national organization representing the timeshare industry. The ROC in ARDA ROC is the Resort Owners’ Coalition looking out for timeshare owners’ or members’ interest. Critics argue ARDA ROC works against timeshare owners when the interest of the owner and the developer diverge. It should be noted that non-deeded point members don’t “own” anything as they are right-to-use programs.

Can ARDA-ROC or ARDA help me?

ARDA provides professional and educational development for its members provides industry research and data and advocates for policies that promote the vitality and continued growth of the industry. Based in Washington, DC, ARDA is comprised of nearly 1,000 corporate members and one million timeshare owner members.

Question: How many readers knew they were a member? Donations range from $3 to $10 as an opt-in or opt-out donation. That adds up to approximately $5 million a year in voluntary donations.  How many timeshare members even know what the letters stand for?  I didn’t. I was told it was an organization that helps timeshare owners. Foreign buyers who buy a US timeshare are also charged. How much do you think they know about ARDA ROC?

Neither ARDA-ROC nor ARDA provide information about complaints they receive.  ARDA-ROC and ARDA do not mediate, arbitrate or otherwise resolve individual disputes between a consumer and an ARDA member or non-member business. They don’t buy or sell timeshares OR recommend companies with whom you should do business. Neither can tell you if a company is “legitimate.”

Timeshare owners, often unaware they have signed a perpetual contract without a secondary market, consider the lack of a secondary their primary concern. ARDA has focused their efforts on chasing timeshare transfer agent scams, but little is mentioned about the cause of the scams, which is the lack of or limited secondary market.

 Thank you to Disney because Disney does allow a secondary market. “Disney is known for exercising their first right of refusal. When a timeshare company exercises their first right of refusal, the effect supports the resale price,” explained Tom Tubbs of Island Consulting Realty. Check out those Disney resale prices. Deeded weeks can almost always be listed. If a resort has converted from weeks to points, non-deeded points with no secondary market will not be listed as the members of the Licensed Timeshare Resale Broker Association feel such points are worthless on the secondary market. If denied a voluntary surrender, a seller in this situation has nowhere to turn but foreclosure or the well reported transfer agencies that may or may not get you out of your timeshare.

Tom cautioned against making a blanket statement accusing ARDA ROC of not doing anything for members. A good example is the Virgin Islands. They are trying to slap an extra $300 onto an exchange. “If that happens, Aruba and other locations may try to follow suit,” warned Tom. In Hawaii, our two bedroom timeshare at Maui Hill slipped in a $6.90 a night Hawaii some kind of tax.

However, when the interests of the timeshare developer are at odds with the timeshare owner, the result is controversy. Issues like:

Owner access to membership lists. Timeshare owners receive endless calls offering vacation giveaways due to a mysterious $1800 credit on our maintenance fees, yet the developers work to pass laws or put up obstacles preventing owners from contacting other owners. No one on our Advocacy Facebook group will question why developers don’t want that!

I asked timeshare Mike Finn of the Finn Law Group why it has been impossible to have my voluntary $7 removed from my timeshare maintenance fee invoice?

“Indeed you are quite correct that several other resorts include a line item in their maintenance fee statement for an ARDA-ROC contribution. I guess they get away with it because it’s allegedly voluntary. However subsequent maintenance billing beyond the first one incorporates that so called voluntary contribution and lumps it in with the subsequent maintenance fee total billing. If you don’t pay your bill after you receive the initial bill and you pay it after you receive a subsequent bill, you’ll probably be inadvertently including that voluntary contribution into your maintenance fee,” Mike explained.

Our Advocacy Group will begin having monthly conference calls to:

  • Target legislators that might be willing to consider owner concerns;
  • Educate the general public about what questions to ask before buying a timeshare. We wish someone gave us that advice!
  • Get updates on current legislation;
  • Get updates on legal and regulatory matters;

Across the oceanic great divide, there is an alphabet soup of timeshare political lobby organizations.  Are they on the side of the timeshare owner or on the side of the developer?

First off, who are they and what are they:

RDO (Charles)

TATOC (Charles)

The RDO, or Resorts Development Organisation, is the trade association for the timeshare industry in Europe, its function is to ensure standards within the industry are maintained and that members abide by a code of conduct. These members fund the organisation with annual subscriptions, they also provide the board of directors, it is a self policing organisation, funded and controlled by the people who make their money selling the products.

The RDO says that it helps to protect the consumer, but as we know, it is their own members who have breached the timeshare laws, just look at the many cases being brought in Spain. The only protection they appear to offer consumers is constantly attacking any company offering a service who is not one of their members. They say you should only deal with RDO “accredited” companies, any other company who is not a member is likely to be a scam.

The press has highlighted in the past, many transgressions RDO members have perpetrated, MacDonald Resorts is just one. This company was the subject of several articles by the Award Winning Journalist Tony Hetherington, one was titled “The timeshare contract that even death will not save you from”. It followed the story of one owner who could not get out of her contract on the death of her husband. What did the RDO do, nothing.

They state one of their missions is to “Educate” journalists as they are ill informed on the subject, that the industry has been the victim of poorly researched articles. Yet these articles are highlighting the plight of their own members customers!

Another partner of the RDO is TATOC, The Association of Timeshare Owners Committees, as the name suggests they represent the owners committees, but how can they represent owners when they are also funded by the industry?

The current CEO, Harry Taylor is no stranger to the Industry, between 14 June 2007 and 18 June 2013, he was listed as a director with Diamond Resorts European Collection Ltd. The strange thing is he is also listed as being appointed director of TATOC at the same time, 23 January 2007. (See Company House PDF).

TATOC should be representing your rights, but we have seen on many occasions they have backed the plans of the resorts / developers themselves, again a case in point is MacDonald Resorts. There has been a move by this company to remove all fixed week owners into their points system, this has been resisted by many owners and is the subject of ongoing battles. Yet the advice from TATOC is to change to the points system, saying it will be better for them, backing MacDonald Resorts to the hilt at the expense of the people they say they represent.

It has been stated by Inside Timeshare many times, there does need to be dialogue between owners, resorts and developers, but the owners should be a separate voice, not one funded (run) by the industry. (See following link on trade associations inc, Tony Hetherington articles)

As for the “voluntary contributions” added to maintenance bills, this does not appear to be the case in Europe, so far we have not seen this and it is possible it would be highly contested if it were to be introduced.

ARDA and ARDA ROC

Timeshare owners worldwide who own a timeshare in the US may pay more attention to ARDA ROC’S “Voluntary” donation this year. Depending on the developer, the fee can range from $3 to $10. Owners must call their resort accounting department to have the charge removed unless it is an “opt-in” request.

For owners asking: “ARDA what?” – ARDA stands for American Resort Development Association and ROC is the timeshare owner arm – Resort Owner’s Coalition.

One reason timeshare owners are taking a closer look is because legislation passed in Florida last year outraged timeshare owners and timeshare advocacy groups. The legislation went into effect July 1, 2015.

One clause, simply put, “Currently, if there are errors in the contract, then a buyer has a right under Florida law to cancel that contract after 10 days. Under the new bill, errors or omissions that are “nonmaterial” would NOT allow a buyer to cancel after 10 days.” (Deanna from Winning the Timeshare Game)
